Abstract

Describing the importance of Standard Essential Patents in fostering innovation and development in Information and Communication Technologies, the article traces the implications and interpretations of the Fair, Reasonable and Non-discriminatory (FRAND) Agreement and emerging issues in the context of Standard Essential Patents in the United States, Europe and China through a brief analysis of recent judicial pronouncements—Microsoft v. Motorola, Apple v. Motorola and others—and systems.

Anurag Kumar Verma, National Law School of India University

Anurag Kumar Verma has studied Information Technology and Geoinformatics before graduating with a Master’s in Public Policy from NLSIU. Interested in Election Systems and Election Studies, he has been exploring IP provisions in context of political parties and election management bodies. With his work, he intends to intereve at the intersection technology and policy to help reform and build robust public systems. His interest in Intellectual Property Rights steems from the application of its study areas in the domain of public policy. He works as a Political Consultant.

Neha Pandey, National Law School of India University

Neha Pandey has a Master's in Philosophy from Delhi University and a Master's in Public Policy from NLSIU. Both intellectual property as an extension of our understanding and treatment of the idea of property, as well as the language of rights and the kind of weight it can and should impose on our resources and values as societies are deep interests of hers. She continues to work on rights based discourses in areas ranging from intellectual property, women's issues, and responsible lending practices within inancial inclusion.

Shubhankar Pradeep, National Law School of India University

Shubhankar Pradeep has a B.Tech in Computer Science from PES University and Master's in Public Policy from NLSIU. After graduation he worked with Microsoft as an engineer but his passion for policy and governance made him pursue MPP. He is interested in the intersection of technology, policy and governance at large and the interplay of these leading to the development of systems and constructs. IP systems in general and its multifaceted aspects of governance in particular is something that greatly interests him.
